深圳市退伍义务兵安置办法
(1994年1月29日深圳市人民政府令第19号发布,根据2004年8月26日深圳市人民政府令第135号修订)
第一条 为做好深圳市退伍义务兵的安置工作,根据国家《退伍义务兵安置条例》,结合深圳市实际情况,制定本办法。
第二条 退伍义务兵安置工作必须贯彻从哪里来、回哪里去的原则和妥善安置的方针。
任何单位和部门(不含外商独资企业),应当履行安置退伍义务兵的义务。
第三条 退伍义务兵安置工作,在市、区人民政府领导下进行。市、区人民政府的退伍义务兵安置机构(以下简称安置机构)是本级人民政府的办事机构,负责办理退伍义务兵安置的日常工作。
市、区人民政府有关部门、街道办事处应协助安置机构做好退伍义务兵的安置工作。
第四条 从深圳市应征入伍和符合本办法第十条规定在异地入伍由深圳市安置的退伍义务兵所需的用工指标,实行计划单列,可预先安置,待计划指标下达后统一结算。
第五条 安置退伍义务兵所需经费,应当纳入财政预算,主要用于退伍义务兵的接待、转送、培训、社会保险和临时困难补助。
前款经费,实行专款专用,任何单位和个人不得挪作他用。
第六条 退伍义务兵回到应落户籍地30日内,应持退伍证和部队介绍信到所在地兵役机关和安置机构报到,办理预备役登记,凭安置机构的证明到所在地公安、粮食部门办理落户和粮食供应关系。
第七条 退伍义务兵入伍前是深圳市农业户口的,按下列规定安置:
(一)对确无住房或严重缺房,自建和靠集体帮助建又确有困难的,区人民政府及其派出机构应帮助提供必要的居住条件;
(二)对有专业特长的,企事业单位在农村招工时,应优先予以录用;
(三)对从事农、牧、渔业生产的,当地有关部门应积极扶持,帮助解决所需场地,优先提供贷款,优先供应生产资料;
(四)入伍前户口随父母,服役期间父母正式迁居城市(系自理口粮户口),退伍时要求随父母落户,并且符合有关落户规定的,可在城市落户(系自理口粮户口),安置机构不负责分配工作。
第八条 退伍义务兵入伍前是深圳市农业户口,退伍时符合下列条件之一的,由安置机构在户籍所在地的镇办企事业单位安排工作,有关部门应免征城市增容费:
(一)符合国家和广东省规定转为城市户口条件的;
(二)因国家建设需要,所在村的耕地部分或全部被征用、并愿意服从分配的。
第九条 对入伍前是城市户口,且没有参加工作的退伍义务兵,在其回到应落户籍地之前,由市人民政府下达预分劳动指标,区人民政府负责一次性安排工作,具体安置由劳动部门会同安置机构负责。
第十条 退伍义务兵入伍前随父母共同生活在外地,服役期间父母迁入深圳市(系城市常住户口),退伍时要求到其父母所在地落户的,由其父母所在地公安派出所和工作单位出具证明,可在深圳市安置,但国家另有规定的除外。
第十一条 接收2、3等伤残退伍义务兵的单位,不得歧视伤残退伍义务兵;无正当理由,不得辞退。
第十二条 患有精神病或麻风病的义务兵退出现役的,在其退伍前,部队应征得应落户籍地的安置机构同意后,派人护送到商定的单位。需要入院治疗的,由当地民政、卫生部门接收治疗。住院期间所需医疗费、医药费和住院费,按下列规定支付:
(一)入伍前没有参加工作的,由退伍义务兵所在区的地方财政经费开支;
(二)入伍前为正式员工(含合同制),已参加医疗保险的,由医疗保险部门支付;未参加医疗保险的,由原单位支付。
第十三条 对退伍义务兵安置到实行全员劳动合同制企事业单位工作的,均实行劳动合同制。安置单位和退伍义务兵应按有关劳动用工规定订立劳动合同。
安置单位无正当理由不得随意辞退所安置的退伍义务兵。
对劳动合同期满解除劳动合同需要重新就业的退伍义务兵,劳动部门或职业介绍机构在同等条件下,应优先介绍其就业。
第十四条 入伍前是国家机关、人民团体、企事业单位正式员工的,退伍后应回原单位复工、复职;原单位已合并的,由合并后的单位负责安置;原单位已分立的,由安置机构指定分立后的单位安置;原单位已终止的,由劳动部门会同安置机构负责安置。
第十五条 入伍前是学校未毕业的学生,退伍后要求复学的,原学校应在退伍后的下一学期准予复学。
第十六条 退伍义务兵报考深圳市高等院校和中等专业学校的,在同等条件下,招生学校应优先录取。
第十七条 退伍义务兵有下列情况之一的,安置机构不负责分配工作:
(一)不具备《退伍义务兵安置条例》第二条规定条件,提前退出现役的;
(二)被部队开除军籍或除名的;
(三)在部队或退伍后待分配期间因犯罪被判处有期徒刑或被处以劳动教养的;
(四)退出现役后超过3个月不到安置机构报到或不办理预备役登记的;
(五)退伍后接到分配工作通知不按规定期限报到逾期1个月的,或不服从分配工作的。
第十八条 退伍义务兵从被批准入伍之日起至被批准退出现役止,为服现役的军龄;满10个月的,按1年计算。
城市退伍义务兵退伍后待分配工作的,其军龄和待分配的时间应计算为连续工龄;入伍前原是国家机关、企事业单位的员工,其入伍前的工龄和军龄连同待分配的时间一并计算为连续工龄,与所在单位员工享有同等待遇。
入伍前是民办教师、退伍后仍被聘为民办教师的,其入伍前的教龄、军龄和退伍后的教龄一并计算为连续教龄。
第十九条 安置单位对按规定分配到本单位的退伍义务兵,不得实行学徒制和试用制。安置单位初次确定退伍义务兵的工资级别,不得低于现岗位同工种、同工龄员工的平均标准工资。
对在部队荣获二等功以上的退伍义务兵、其工资按上述原则确定后,可以高定1级。
第二十条 被安置的退伍义务兵与安置单位的现员工,享有同等的福利待遇;在同等条件下,安置单位对所安置的退伍义务兵优先分配住房。
第二十一条 入伍前是本市城市户口待业人员,服现役期间的军龄按第十八条规定计算为工龄的,其应补交的社会保险费用由区财政拨付,由安置机构缴纳。
入伍前是正式员工,其应补交的社会保险费用,按市政府的有关规定办理。
第二十二条 对违反本规定,拒绝接收或故意拖延接收退伍义务兵的单位,劳动部门在2年内不予批准该单位的用工指标;对单位负责人,有关部门可给予行政处分。
第二十三条 本办法自发布之日起施行。深圳市过去所发的有关规定与本办法相抵触的,按本办法执行。

There is hereby established a body to be known as the Securities

The Commission shall be a body corporate with power to sue

《南宁市商品房销售合同网上登记备案管理办法》已经市人民政府常务会议审议通过,现印发给你们,请认真贯彻执行。

南宁市商品房销售合同网上登记备案管理办法
第一条 为规范商品房销售管理,提高商品房交易信息的透明度,维护商品房买卖双方合法权益,依据《城市房地产开发经营管理条例》、《南宁市城市房地产交易管理条例》,结合本市实际,制定本办法。
第二条 本市城市规划区内新建商品房销售合同的网上登记备案适用本办法。
本办法所称商品房销售包括商品房现售和预售。
第三条 市房产管理局负责商品房销售合同网上登记备案的组织实施及相关管理工作。
第四条 房地产开发企业在申请商品房预售许可及商品房销售备案时应向市房产管理局申请办理商品房销售合同网上管理认证手续,市房产管理局应在受理申请后3个工作日内完成认证工作。
第五条 商品房销售前,市房产管理局应当通过网上管理系统公开下列信息:
(一)商品房销售的相关信息,包括商品房预售许可证号、商品房销售备案证明编号、房地产开发企业名称、楼盘名称、楼盘座落、房屋类别、可预售建筑面积;商品房的《建设工程规划许可证》、《建设工程施工许可证》编号、建设规模、设计用途,《国有土地使用权证》编号、土地用途和使用年限;
(二)商品房的楼盘表及建筑面积测绘成果;
(三)建设部和国家工商行政管理总局联合制定的商品房销售合同示范文本;
(四)商品房交易状态,包括可售、不可售、已售、已办理合同备案、已申请预购商品房抵押登记、已办理预购商品房抵押登记、已办理抵押登记等;
(五)商品房销售情况;
(六)商品房项目竣工及交付使用的日期。
本办法规定的商品房销售合同,使用建设部和国家工商行政管理总局联合制定的示范合同文本。
第六条 房地产开发企业应当向市房产管理局申报商品房拟销售的价格。
第七条 商品房销售的当事人双方根据合同示范文本协商拟订合同条款,并经当事人双方确认后,签字盖章。
第八条 商品房销售合同正式签订后,房地产开发企业应当立即将合同、购房人身份证明或法人资格证明等证明文件扫描后通过网上管理系统提交市房产管理局,并通过网上管理系统进行商品房销售合同备案。
商品房销售合同备案后,商品房楼盘表上即时显示该套商品房已备案,供购房人查询。
第九条 购房人申请房屋权属登记前,当事人双方经协商一致,需要对合同中的选择性条款或双方可以自由约定的条款的内容进行变更的,应当持已备案的书面合同、变更合同的书面协议及其他有关材料,向市房产管理局申请办理合同变更备案手续。
第十条 当事人双方协商一致,需要解除商品房销售合同的,应当持已备案的书面合同、解除合同的书面协议及其他有关材料,向市房产管理局申请办理解除合同备案手续。
发生前款所列情形的,市房产管理局应及时修改商品房楼盘表内该套商品房销售合同备案情况,并及时在网上公布。
第十一条 市房产管理局应当定期汇总、分析和发布全市新建商品房的交易信息,并提供网上查询服务。
第十二条 本办法具体应用问题,由市房产管理局负责解释。
第十三条 本办法自颁布之日起施行。本办法施行前已办理商品房预售许可或现售备案且正在发售的商品房项目的销售合同备案参照本办法执行。
